1. About DgtlStream
DgtlStream is a technology company focused on building digital products that simplify complex problems and improve everyday life. We design, develop, and operate proprietary platforms and applications (including ZonicWorks and others) under a unified ecosystem of digital innovation.
Each individual product or platform operated by DgtlStream may have its own supplemental terms, which will apply in addition to these general Terms.
2. Eligibility
You may use our Services only if you:
- Are at least 18 years old (or the age of majority in your jurisdiction);
- Have the legal capacity to enter into a binding agreement; and
- Use the Services in compliance with these Terms and all applicable local, national, and international laws and regulations.

We reserve the right to modify, expand, or discontinue any part of our Services at any time without notice or liability.
5. User Accounts
Certain features require account registration. When creating an account, you agree to:

Violation of this section may lead to immediate termination of access and legal action.

Our Services may include integrations, links, or references to third-party websites and tools. DgtlStream does not endorse, control, or assume responsibility for third-party content or practices. Accessing any third-party website is at your own risk and governed by that party’s terms and policies.
9. Product-Specific Terms
Each DgtlStream platform (e.g., ZonicWorks) may have its own additional Terms of Use, Service Agreements, or Policies. Where such product-specific terms apply, they shall be read in conjunction with these general Terms. In case of conflict, the product-specific terms shall prevail.
10. Data Protection and Privacy
Your use of our Services is also governed by our Privacy Policy, which explains how we collect, store, process, and share your personal data in compliance with applicable privacy laws, including the Information Technology Act, 2000 (India), GDPR (EU), and other relevant frameworks.
By using our Services, you consent to the collection and use of your data in accordance with our Privacy Policy.
11. Software, Updates, and Modifications
DgtlStream may automatically update or modify software components to enhance functionality, security, or performance. You consent to such updates and understand that older versions may become unsupported or disabled.
We reserve the right to discontinue or restrict features or functionalities without notice.
12. Suspension or Termination
We may suspend or terminate your account or access to our Services if:
- You violate these Terms or applicable laws;
- We detect fraudulent or abusive behavior; or
- Maintenance, security, or operational needs require such action.
Upon termination, all rights granted to you under these Terms will immediately cease, but provisions such as intellectual property, limitation of liability, and indemnification will continue to apply.
13. Disclaimers
To the maximum extent permitted by law:
- The Services are provided on an “as is” and “as available” basis;
- DgtlStream makes no warranties (express or implied) about accuracy, reliability, or suitability for a specific purpose;
- We do not warrant that Services will be uninterrupted, secure, or free from errors or viruses.
Your use of the Services is solely at your own risk.
14. Limitation of Liability
To the fullest extent permitted by law, DgtlStream, its affiliates, officers, employees, or partners shall not be liable for:
- Any indirect, incidental, special, or consequential damages;
- Loss of profits, data, goodwill, or business opportunities;
- Errors or inaccuracies in the Services;
- Unauthorized access or use of your data.
In all cases, DgtlStream’s total liability shall not exceed the amount (if any) paid by you for the Services during the six (6) months preceding the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless DgtlStream, its directors, employees, affiliates, and agents against any claims, liabilities, damages, or expenses (including legal fees) arising from your:
- Breach of these Terms;
- Use of the Services;
- Violation of any rights of a third party.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New Delhi, India for any disputes arising out of or related to these Terms.
17. Compliance with Laws
Users must comply with all applicable laws, including but not limited to the Information Technology Act, 2000, Consumer Protection Act, 2019, GDPR, Digital Personal Data Protection Act, 2023, and other international digital conduct standards.
18. Force Majeure
DgtlStream shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, wars, government actions, or network failures.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent. DgtlStream may assign its rights to any affiliate, successor, or acquirer as part of a merger or restructuring.
20. Entire Agreement
These Terms, along with our Privacy Policy and any product-specific policies, constitute the entire agreement between you and DgtlStream and supersede all prior agreements, written or oral, regarding the Services.
